In accordance with the Animal Health Personnel Act § 3 a, the municipalities are required to ensure satisfactory access to services from animal health personnel, as well as responsibility for organising clinical veterinary duty outside ordinary working hours. Hemsedal, Gol, Nesbyen and Flå municipalities are included in the duty district Nedre Hallingdal and shall cooperate on veterinary duty services. The veterinary duty is a necessary part of the stand-by against serious animal diseases and it is important for maintaining good animal welfare.
In the duty district it is currently difficult to recruit veterinary surgeons, and for the duty district Nedre Hallingdal there is mainly only one tenderer who can provide this service with a rotation that is both within the regulations stipulated in the Working Environment Act and at the same time is a rotation that is liveable for veterinary surgeons. The veterinary surgeons Nedre Hallingdal AS will be able to provide a service with five veterinary surgeons who treat both small animals and production animals that go shifts in rotations, both clinical veterinary duty outside ordinary working hours and day shifts08.00 – 16.00.
The contract therefore fulfils the Public Procurement Regulations § 5-2. Exceptions from part II, (1) Part II will not apply for contracts that, a. the Contracting Authority can only be included with a specific tenderer in the market.
